About these terms
WP Moo is a service of tukkr LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States of America ("we", "us"). These terms apply to everyone who creates an account or uses the dashboard ("you"). If you create an account for a company or agency, you accept these terms on its behalf and confirm you're allowed to.
WP Moo is made for businesses: agencies, freelancers and companies who look after websites. It is not offered to consumers.
The data processing agreement is part of these terms. It covers the personal data we process for you. How we handle your own details as an account holder is in the privacy policy.
The beta
WP Moo is in an invite-only beta. During the beta:
- the service is free;
- features, limits and checks can change, and some may be removed;
- there is no guaranteed uptime or response time, though we aim to reply to support email within 1 business day;
- we may end the beta, or your access to it, with at least 14 days' notice by email.
Your account
Give us correct details and keep them up to date, so alerts and account emails reach you. Keep your password to yourself. You are responsible for what happens in your account, and you tell us at [email protected] as soon as you think someone else got in.
Each account belongs to one organisation. The limits on sites, pages and check intervals are shown in the dashboard.
Sites you monitor
Only add sites you own, or sites whose owner allows you to monitor them. By adding a site, you allow our checker to visit it as described on our checker page: plain GET requests from our published IP addresses, never logging in or filling in forms.
If a firewall or security plugin blocks our checker, results for that site are incomplete until you let it in. We aren't responsible for problems a block hides.
Fair use
Don't use WP Moo to:
- monitor sites you're not allowed to, or put load on a site on purpose;
- break the law, or send alerts to people who didn't agree to receive them;
- get around the limits, probe our systems for weaknesses or try to reach other customers' data;
- copy, resell or rebuild the service.
Found a security problem? Email [email protected] and we'll work with you on it.
Our service
WP Moo, its software, design, texts and name belong to tukkr LLC. While you have an account, you may use WP Moo for your own business and for the sites you look after for your clients. That right is personal: you can't sell it, transfer it or license it to others. Nothing in these terms gives you any other right to our software or brand.
Your data
The sites, pages, servers, settings and check results in your account are yours. We use them only to run WP Moo for you, as set out in the data processing agreement. You give us the right to store, copy and process this data, and what our checker reads on your sites, as far as needed to run WP Moo for you. We may use counts and other numbers that can't be traced back to you or your sites to keep the service running and to improve it.
Alerts
We work hard to tell you about every problem, and to not bother you about problems that aren't there. Still, a check can miss something, an alert can arrive late, or an email can end up in a spam folder. WP Moo helps you notice problems; it doesn't replace backups, security updates or your own care for a site.
Fees
The beta is free. If we introduce paid plans, we'll tell you at least 14 days in advance, and you only pay once you choose a plan.
Ending the agreement
You can stop at any time by deleting your account in Account settings. We stop all checks straight away and delete your sites, settings and history after 14 days, unless you log in to restore it before then.
We may suspend or close an account that breaks these terms. Where an account puts the service, our checker's reputation or other customers at risk, for example through abuse, unusual load or a security problem, we may suspend it straight away and without notice. In other cases we tell you first and give you a chance to fix it.
Liability
WP Moo is provided as it is during the beta. We don't promise that it detects every problem, that it works without interruption or errors, or that it suits a particular purpose. As far as the law allows:
- we aren't liable for indirect or consequential loss, such as lost revenue, lost profit or lost data;
- our total liability is limited to €100, or to what you paid us in the 12 months before the claim if that is more.
These limits don't apply to loss caused by our intent or gross negligence, or where the law doesn't allow them.
A claim against us must be made within 1 year after the event it is about; after that it lapses.
Claims by others
You compensate us for claims from others, and the reasonable costs of defending them, that arise because you monitored a site without permission, added an alert address without the person's consent, or otherwise broke these terms or the law. We tell you about such a claim promptly and let you take part in the defence.
Events outside our control
We aren't liable for failing to provide WP Moo, or for providing it late, because of events outside our reasonable control, such as outages at our hosting, network or email providers, attacks on our systems, power failures, or government measures.
Changes to these terms
We may change these terms, for example when the beta ends or when the service changes. The date at the top shows the version. For a change that matters to you, we email account owners at least 14 days before it applies. If you don't agree, you can delete your account before then. If you keep using WP Moo after the change applies, you accept the new terms.
Other terms
- Notices: we send notices to the email address of the account owner. They count as received on the day we send them.
- Transfer: we may transfer this agreement to a company that takes over WP Moo or to another company of ours, and tell you by email. You need our written consent to transfer it.
- Feedback: if you send us ideas or suggestions, we may use them freely, without owing you anything.
- Only the two of us: only you and we have rights under these terms. Your clients and other third parties can't claim under them.
- Whole agreement: these terms and the data processing agreement are the whole agreement about WP Moo, and replace anything agreed before. Your own purchase or supplier terms don't apply.
- Invalid parts: if part of these terms is invalid, the rest still applies, and the invalid part is replaced by a valid one that comes closest to its purpose.
- No waiver: if we don't enforce a right straight away, we don't give it up.
Law and disputes
These terms are governed by the law of Ireland. Disputes go to the courts of Ireland. Before going to court, email [email protected] so we can try to solve it together.
